Justiça volta atrás e devolve presidência da Câmara de Belford Roxo a Markinho Gandra

O ministro André Mendonça, do Supremo Tribunal Federal (STF), reconsiderou decisão anterior e determinou o retorno do vereador Markinho Gandra (União Brasil) ao cargo de presidente da Câmara Municipal de Belford Roxo, na Baixada Fluminense.

Gandra havia sido afastado pelo próprio ministro no dia 7 de outubro, após questionamentos sobre a legalidade de sua terceira eleição consecutiva para o comando da Casa — o que é vedado pela Constituição Federal, pela Lei Orgânica do Município e pelo Regimento Interno da Câmara.

A ação foi movida pelo partido Republicanos, que contestou a eleição antecipada da Mesa Diretora para o biênio de 2025-2026, na qual Gandra havia sido reconduzido ao cargo.

Ao reavaliar o caso, Mendonça concluiu que o afastamento imediato do parlamentar não era o objeto principal da ação, que se restringe à análise da validade da reeleição sucessiva. Assim, determinou o retorno de Markinho Gandra à presidência, mas manteve suspensos os efeitos da eleição da Mesa para o exercício de 2026, até o julgamento definitivo da ação.
