Audiência com a Associação Brasileira de Mobilidade e Tecnologia e motoristas determinou que empresas informem, dentro de sete dias, o tempo de adaptação nos aplicativos
Nesta quarta-feira (10), o Governo do Estado, por meio da Secretaria de Defesa do Consumidor, se reuniu com membros da Associação Brasileira de Mobilidade e Tecnologia (Amobitec) e representantes de transporte por aplicativo para debater a resolução que estabelece regras às plataformas quanto ao uso do ar-condicionado. No encontro, ficou determinado o prazo de sete dias para que as empresas informem o tempo necessário para a adaptação às regras estabelecidas pela resolução.
– Durante a pandemia, os carros tinham que circular com vidros abertos e ar-condicionado desligado. Essa prática permaneceu e não está claro para o passageiro se, ao solicitar uma viagem no aplicativo, o serviço será oferecido ou não. Nosso papel é pacificar a relação entre prestadores de serviço e consumidores. Não são normas novas, o que a resolução determina é o cumprimento do Código de Defesa do Consumidor, que estabelece que a informação seja clara e precisa na contratação de serviços – esclarece o secretário de Estado de Defesa do Consumidor, Gutemberg Fonseca.
Para acompanhar o cumprimento da determinação, o Governo do Estado está com uma equipe de fiscalização nas ruas. Até que as plataformas se atualizem, todos os carros por aplicativo devem andar com ar-condicionado ligado.
– Temos técnicos nas ruas e orientamos todas as autoridades públicas sobre a resolução. Se o passageiro entrar no carro hoje, pedir para ligar o ar-condicionado e o motorista se recusar, o consumidor pode chamar um agente público para dar o flagrante e levá-lo para a delegacia. Isso já se torna crime contra o consumidor – acrescentou o secretário.

Desde segunda-feira (8), quando foi publicada a resolução no Diário Oficial, o canal Fala Consumidor já recebeu 163 mensagens. Entre as reclamações, relatos de passageiros que não foram informados no momento da contratação do serviço sobre o direito ao uso do ar-condicionado, mesmo em corridas de longa duração. O WhatsApp da Secretaria também recebeu dúvidas de motoristas sobre a aplicação das novas regras.
