Justiça do RJ proíbe confisco de créditos não utilizados do RioCard

A Justiça do Rio de Janeiro acatou um pedido da Defensoria Pública e proibiu a prática de confiscar créditos não utilizados nos cartões RioCard após um ano. Com essa decisão, todos os valores retidos e não utilizados serão devolvidos aos consumidores após o trânsito em julgado.
A decisão também impõe uma multa de R$ 5 milhões à Fetranspor e à empresa administradora do RioCard por danos morais coletivos. Esse valor será destinado ao Fundo de Direitos Difusos do Ministério da Justiça.
O sistema RioCard permite que consumidores carreguem valores a serem usados posteriormente no transporte coletivo. A prática de confiscar créditos não utilizados havia sido contestada pela Defensoria Pública do Rio de Janeiro desde 2017, quando o Núcleo de Defesa do Consumidor (Nudecon) iniciou uma ação judicial para proibir a apropriação desses saldos pela Fetranspor.
